SUMMER  WORK PLACEMENT CONTRACT

The following was agreed upon :

The Director of the hotel company mentioned above agrees to accept in his establishment the following student for a period of 4 months :

The goal of this training period is to improve the student’ s skills in the overall activities of the hotel/company.

Stipulations and Conditions

ARTICLE I – DURATION OF WORK PLACEMENT : 4 months

From April 18th 2005 to August 6th 2005 included.

In no case can the duration be changed without the approval of the school Director.

ARTICLE II – WORK SCHEDULE

In no case shall overtime hours be required of the trainee.

a) starting and ending time of the work day, the total number of hours worked, uninterrupted work breaks are strictly determined according to the law.
b) The law regarding weekly days off will be applied.

ARTICLE III.  – FRINGE BENEFITS AND ALLOWANCE

a) The trainee gets full board accommodation (room and food) and laundry service at the hotel’s expense under the following conditions:

Food : substantial and quality food must be provided to the trainee.

Bed(room) : the trainee is housed in a clean room, well-ventilated, where he can rest during the day and night. The room contains a single bed and a cupboard or wardrobe with a lock. The room shall be equipped with a washbasin with running water. The trainee must also have unlimited and free use of shower facilities (without incurring any cost).

In no case must the trainee share the room with employees older than him.

Laundering : laundering of the trainee’s work clothes (white jackets, white shirts, collars, kitchen jackets and trousers, socks, chef’s hat, aprons) is provided at the hotel’s expense. 

b)

Travelling expenses , from the trainee’s residence to the training establishment, are reimbursed by the hotel on the basis of a second-class SNCF ticket. 
outward trip: at the end of the first month of the training period
return trip: at the end of the second month.

c) Taking into account the conditions set forth under this article, the trainee must receive a net minimum allowance of  280€  which must be paid at the end of each month

 

ARTICLE IV - ADMINISTRATIVE EXPENSES AND SUPERVISION

The hotel/ company pays the school , at the time of signing this contract, and before the 1st of May, a sum of  (76€)  per trainee

 

ARTICLE V  - CIVIL AND ACCIDENT LIABILITY

a) During the duration of the training period, the director of the hotel/ company will be held liable for the trainee, under articles 1382-1383-1384 of the Civil Code regarding apprentices.
b) The trainee is an affiliated member of Social Security , under the care and responsibility of the hotel, for all risks covered by this institution. To this end, the trainee’s Social Security registration number will be passed on to the director of the hotel/ company
c) The student is under the care and responsibility of his/her parents during the duration of the trip between his / her residence and the training establishment, including return trip home .The school nor the Director of the hotel / company will be responsible for events occurring  during the course of these trips. 
d) The school nor the Director of the hotel/ company will be responsible for events occurring during nights out (or evenings) , swimming, sailing, climbing and any non-work related activity involving particular risks.

 

ARTICLE VI  - TRAINEE’S RESPONSIBILITIES

a) the person in charge  / the parents  ensure(s) the trainee’s loyalty, obedience and respect for the  Director of the hotel/ company , as well as for all persons who must help  or stand in for him/her in his training mission. 
b) Under conditions of this present contract , the trainee must help his training director to the best of his skills and abilities . He/she is committed, furthermore, to be on his/ her best behaviour both inside and outside of work.
c) Except under serious circumstances and, only with the agreement of both contracting parties and the Director of the school, can the trainee terminate his/her training period before the end of the fixed period.
Should the student  terminate his/her training period  of his / her own will, he / she will be expelled from the school.
d) In case of absence due to sickness or injury , the trainee must inform the school immediately and provide a medical certificate.
e)   In early September , the trainee will send the Director of the school a short report about the placement he / she has completed.

 

ARTICLE VII – RESPONSIBILITIES OF THE TRAINING DIRECTOR

 a)

The placement is a curriculum requirement, compulsory for the student, who has to comply with the regulations outlined in the present contract. All important decisions concerning the trainee must be taken  with the agreement of both contracting parties and the Director of the school.
b) The training Director should be a role model  for the trainee, supervise his / her behaviour  as much as possible, circumstances permitting, and inform the parents or legal guardian(s) of any gross misconduct that the trainee may commit or of any reprehensible conduct that may bring himself / herself into disrepute. 
During the training period, the training Director will assume the educational role of the Director of the school. He will advise the student and entrusts him / her with more and more complex tasks , so that he / she will develop his / her sense of responsibility and improve his / her professional skills.
c) The training Director will greet the student upon his / her arrival . He will give him / her useful information about the establishment and its operations. He will give the trainee a tour of the main departments so that the trainee understands his / her position in relation to other positions.
d) The trainee can be placed in another establishment  or position  at the beginning or during the training period only with the agreement of  the parents (or legal guardian(s)) and the Director of the school.
e) The Director of the school or his / her representative  will ensure that the trainee actually performs his / her duties in the appointed establishment and is entitled to verify , at any time, the adherence to the conditions of the present contract. 
f) At the end of the training period, the training Director gives an assessment of the trainee’s behavior, work and progress. This assessment addressed to the Director of the school will constitute an important document  in the student's educational report.
